Fashion Retail España, S.A. and ITX Fashion Limited (jointly, the “Promoter”) jointly organize a prize draw (the “Prize Draw”) which shall be governed by these rules (the “Rules”).
The prize of the Prize Draw consists of one lot of Uterqüe products including:
The lot shall be made up by the Promoter at its sole discretion and three different versions will be available. The winner may choose between any of the available versions.
The prize is personal to the winner and non- transferable and cannot be exchanged for cash.
The Prize Draw is open to the entry of any person over 18 or underage duly authorized as indicated below, residing in Germany (except for the island of Helgoland and the town of Büsingen), Spain, France (except for the Overseas Departments), Portugal, United Kingdom (only in Mainland), Belgium, The Netherlands, Austria and Switzerland, who registers in the “newsletter” section of the www.uterque.com website (the “Website”) between 25 April and 6 May 2012, in the terms mentioned below.
Underage shall have their parents, guardian´s or legal representatives´ consent to enter in the Prize Draw as well as to receive the prize, where appropriate.
Entrants may only enter the Prize Draw once, for a single registration in the “newsletter” section of the Website”.
People not complying with the abovementioned requirements may not enter the Prize Draw.
To enter the Prize Draw registration in the “newsletter” section of the Website between 25 April and 6 May 2012.
In order to register completion of the registration form following the instructions available for such purpose and acceptance of these Rules are required.
The Prize Draw will be held before a Spanish Notary on 8 May 2012.
One single winner shall be chosen and one replacement, who would become the winner should it not be possible to contact the winner within 5 working days of the date of the Prize Draw, should the winner fail to comply with the requirements to claim the prize or should the winner waive the prize. Should it neither be possible to contact the replacement within 5 working days or should he/she fail to comply with the requirements to claim the prize or should he/she waive the prize, the prize of the Prize Draw shall be declared void.
The winner will be contacted by the Promoter via e-mail or telephone. The winner shall send to contact@uterque.com a copy of his/her national identification document.
The Promoter reserves the right to (i) amend all or part of these Rules, (ii) interrupt or cancel the Prize Draw at any time; (iii) declare the Prize Draw void according to the abovementioned; (iv) withdraw any amounts in respect of the prize of the Prize Draw or carry out any other tax actions related to the Prize Draw which may be established by applicable law, for which purpose, the winner may be required to sign the relevant documents and (v) bring legal actions against the persons who might carry out any act that may be considered as manipulation or fraud of the Prize Draw.
The Promoter shall not be liable for (i) the deficiencies or the breakdown of telecommunications lines/systems, nor for the mal-function of the web pages, web sites, microsites or similar means that form part of the Prize Draw or are used for its performance, nor for the delay in the transmission of information/data or the loss of information/data which may result out of any of the aforementioned events, (ii) the impossibility of awarding the prize as consequence of the inaccuracy of the data provided by the entrants and (iii) any possible loss, damages, theft, delays or any other circumstance attributable to a third party which may affect the development of the Prize Draw.
Each entrant represents that (i) he/she meets all the requirements and conditions to enter the Prize Draw (ii) the information and/or data provided by him/her in the Prize Draw are true and accurate, and (iii) he/she accepts these Rules.
By virtue of the above, each entrant shall be liable vis-à-vis the Promoter for any loss or damage arising from (i) the inaccuracy or untruthfulness of the information and/or data provided within the framework of the Prize Draw or (ii) the breach of these Rules by him/her.
The entrants in the Prize Draw, hereby authorize the Promoter to publish their names and surnames through any means, for the purposes of informing about the result of the Prize Draw.
ITX Fashion Limited will be the owner of a personal data file for the purposes mentioned below.
All personal data provided by the each of the entrants registered in the newsletter section of the Website, expressly including the processing of his/her personal image should he/she be the winner of the Prize Draw and should he/she accept the prize, will be processed in a file with the following purposes:
Furthermore, in case of being awarded the prize, the entrant consents in the publication of his name and surname as a winner in the place and while the time set in clause number 5 in the present Rules.
Entry in the Prize Draw by the entrants entails their express consent to the processing of the personal data provided for the purposes described in these Rules, being entitled to exercise their access, rectification, cancellation and objection rights by sending a letter and a photocopy of their passport or valid identification document for the attention of "Función LOPD” to the address Avenida de la Diputación, Edificio Inditex, 15142 Arteixo (A Coruña) or by sending an e-mail to funcionlopd@inditex.com, proving as well the identity. Should you whish to exercise such rights and your e-mail is among the personal data provided by you, we would appreciate that in the mentioned letter you mention that circumstance, indicating the e-mail address regarding which the access, rectification, cancellation and objection rights are exercised.
To comply with the abovementioned purposes, we may have to communicate or assign the information provided by you to Industria de Diseño Textil, S.A. (Inditex, S.A.), the Promoter and to other group companies of the Inditex Group (whose objects are related to the decoration, textile, finished fashion and homeware products sectors, and to any other objects supplemental to the above, including cosmetics and leather goods); therefore we understand that by registering and providing us with information in this website, you expressly authorize us to carry out such communications and/or assignments.
The use of any social media button available in the prize draw (social media share) doesn’t imply in any data processing by the Promoter.
These Rules shall be governed by Spanish law. In case of any discrepancy between the Spanish and English versions of these Rules, the Spanish version shall prevail.
